 Adopt the necessary election rules

Please reach out to your associations legal counsel for more information and guidance on how to amend your existing election rules for California.

Electronic voting can only occur after HOA's amend their election rules to permit e-voting. Please remember that amendments to election rules are required to be adopted at least 90 days before an election can take place. So plan accordingly as most election rules amendments can take at least 2-3 months + to complete. Contact your association's legal counsel to adopt new election rules.

How to get ready as a HOA
manger or homeowner?

Electronic HOA voting cannot occur unless their HOA adopts electronic voting rules and any homeowner/member will be given the opportunity to opt out of electronic voting if they prefer mailing of election materials. Homeowners who are interested
in electronic voting should contact their association and/or managing agent to make sure they have an owners email address on file. HOA’s should add a paragraph to their Annual Disclosure packet allowing homeowners to decide whether
they want to “opt in” or “opt out” of e-voting and the deadline
for doing so. New homeowners to an association should also
have the option during the escrow process to choose their
voting preference.
